Data Protection

SkoldMarketer treats data protection as core architecture, not an afterthought. This section states plainly, as a matter of record, how your data and your customers' data are actually handled today.

Current hosting: production infrastructure is hosted on EU-based servers under GDPR. A dedicated migration to Australian-based infrastructure is in progress; this page will be updated to reflect that the moment it's actually live — we don't claim a residency arrangement before it's real.

Sub-processors: we use standard, named sub-processors where needed — for example, Stripe for payment processing. We're upfront about which third parties touch your data rather than leaving it unstated.

Security in transit and at rest: data is encrypted in transit (TLS) and at rest. Customer workspaces are logically isolated from one another at the database level.

Consent provenance: our email tooling records where and when a contact's consent was actually given, and honors suppression/unsubscribe requests — not just a one-time checkbox with no audit trail.

Who this agreement is with

These Terms of Service govern your access to and use of the SkoldMarketer platform, including the website builder, content generation, listing sync, review management, email marketing, and referral program features (the "Service").

Acceptance

By creating an account or otherwise using the Service, you agree to these Terms. If you're using the Service on behalf of a business, you're confirming you have authority to bind that business to these Terms.

Your account

You're responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly if you suspect unauthorized access.

AI-generated content — your review is the final step

SkoldMarketer uses AI to draft website copy, articles, social posts, emails, and review replies, grounded in the business information you provide. Nothing generated is published, sent, or posted automatically without your review and approval — you're responsible for checking that any content you approve is accurate before it goes out under your business's name.

Your content and data

You retain ownership of the business information, content, and customer data you provide or that's generated for your business through the Service. You grant SkoldMarketer the limited right to process that data as needed to provide the Service to you.

Acceptable use

You agree not to use the Service to:

• Send unsolicited communications in violation of applicable spam or telemarketing laws;
• Publish content that is unlawful, defamatory, or infringes someone else's rights;
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service;
• Misrepresent your business's identity or use the Service to impersonate another business.

Fees and billing

Subscription fees, billing cycles, cancellation, and refund terms are set out in our Billing, Cancellation & Refund Terms, which forms part of this agreement.

Suspension and termination

You can cancel your subscription at any time from your billing dashboard. We may suspend or terminate access to the Service for a material breach of these Terms.

Service availability

We aim to keep the Service reliably available but don't guarantee uninterrupted access — third-party dependencies (such as Google's own APIs for listing sync and review management) can affect availability of specific features outside our control.

Limitation of liability

To the maximum extent permitted by law, SkoldMarketer's liability for any claim arising from your use of the Service is limited to the fees you paid in the 12 months before the claim arose. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or other right under the Australian Consumer Law that cannot lawfully be excluded.

Governing law

These Terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.

We keep the full Privacy Notice on the application itself rather than duplicating it here, so there's only ever one current version to maintain and refer to — this avoids two copies quietly drifting out of sync with each other over time.

This site — the page you're reading, and the rest of skoldmarketer.com — sets no cookies at all. It's static, with no analytics, tracking, or third-party scripts.

The SkoldMarketer application (app.skoldmarketer.com)

Once you sign up and use the actual product, a small number of cookies are used:

The non-essential analytics cookie is consent-gated: a visitor to a SkoldMarketer-generated website sees a consent banner first, and no tracking cookie is set unless they accept. Rejecting it doesn't block access to the site — it just means that visit isn't counted in your analytics.

Managing cookies

You can control or delete cookies through your browser's own settings at any time. Blocking the strictly-necessary session cookie will prevent you from staying logged in to the SkoldMarketer dashboard.
